The Short Version

When you buy My Eulogy File, you’re buying a digital product for your own personal use.

You can download it, save it, print it, make sensible backup copies, and use it as many times as you reasonably need for your own My Eulogy File.

You can also let the people who eventually deal with your eulogy access and use your copy. That’s rather the point.

You cannot buy one copy and distribute blank copies to your family, friends, clients, workshop participants, or anyone else who would otherwise need their own copy.

You also can’t resell it, republish it, upload it for other people to download, remove our branding and claim it as your own, or use it to create a competing product.

Because this is an immediately downloadable digital product, you will be asked at checkout to agree to receive it straight away and acknowledge that, once supply begins, you lose the statutory 14-day right to change your mind. This does not affect your rights if the digital content is faulty, not as described, or otherwise fails to meet your statutory rights.

These Terms of Sale & Licence apply when you purchase My Eulogy File or another digital product sold by Your Eulogy where these Terms are stated to apply.

Please read them before purchasing.

What You’re Buying

My Eulogy File is a digital downloadable product.

It contains questions, prompts, guidance, and resources designed to help you collect information that may eventually be used to write your eulogy.

The product description on the website will explain what is included in the version you are purchasing.

Unless we specifically say otherwise, you are not purchasing:

  • a physical product;
  • a printed workbook;
  • an online account;
  • cloud storage;
  • a digital vault;
  • personalised eulogy-writing services;
  • counselling or bereavement support;
  • funeral planning;
  • legal or medical advice; or
  • somewhere to store your completed answers.

We provide the workbook.

You provide the life.

Your Answers Are Separate

My Eulogy File deliberately doesn’t provide fixed writing spaces for your answers.

You may choose to use:

  • a notebook;
  • a ring binder;
  • a folder;
  • loose pages;
  • a digital document; or
  • another method that works for you.

Your answers aren’t submitted to Your Eulogy as part of the product.

We don’t provide online storage for your completed File.

Please don’t send your completed My Eulogy File to us.

Ordering and Payment

My Eulogy File and our other digital products are currently intended to be sold and delivered through Payhip.

The price payable will be the price shown to you when you place your order, together with any applicable taxes or other charges clearly disclosed before purchase.

Payment will be processed through the payment arrangements available through Payhip.

We don’t receive or store your full payment card details.

You are responsible for providing accurate information when making your purchase, particularly your email address where it is needed for your order or delivery.

When the Contract Is Made

Your order is an offer to purchase the relevant digital product under these Terms.

A contract between you and Your Eulogy is formed when your order is accepted and payment is successfully processed, subject to the checkout arrangements used by Payhip.

You should receive confirmation of your purchase in a form that you can retain.

UK distance-selling rules require traders to provide specified pre-contract information and confirm the contract on a durable medium such as email.  

Digital Delivery

My Eulogy File is intended to be available for digital delivery following successful payment.

The precise method of accessing your download will be provided through the purchase and delivery system.

You are responsible for:

  • providing a working email address where required;
  • having a suitable device and software to access the supplied format;
  • downloading and saving your copy; and
  • making reasonable backups once you have received it.

We’ll try to resolve the problem.

Your Right to Cancel

This section is important.

Consumers buying digital content online will generally have a 14-day cancellation period.

However, different rules apply where you want digital content supplied immediately.

If you want access to My Eulogy File before the end of that cancellation period, UK law requires you to:

  1. expressly consent to the supply of the digital content beginning immediately; and
  1. acknowledge that you will lose your statutory right to cancel once supply begins.

If those requirements are met and supply begins, your 14-day cancellation right is lost.  

You will therefore be asked to give the necessary consent and acknowledgement as part of the checkout process before the download is supplied.

This does not remove your statutory rights if there is something wrong with the digital content.

Refunds and Faulty Digital Content

Losing the 14-day change-of-mind cancellation right does not mean you have no rights after downloading the File.

Under the Consumer Rights Act 2015, digital content supplied to consumers must meet statutory requirements, including being of satisfactory quality, fit for its applicable purpose, and as described.  

If the File:

  • is corrupted;
  • cannot reasonably be accessed in the advertised format;
  • is materially incomplete;
  • isn’t what we described;
  • or otherwise fails to meet your applicable statutory rights,

Depending on the circumstances and your statutory rights, an appropriate remedy may include providing a working or corrected copy or, where applicable, a price reduction or refund.

Nothing in these Terms removes or restricts consumer rights that cannot legally be excluded.

Changing Your Mind Is Different From Something Being Wrong

Because this distinction is easy to lose in legal wording:

“I downloaded it and have decided I don’t want it”

is a change-of-mind cancellation.

If you expressly requested immediate delivery and acknowledged the loss of your cancellation right before supply began, you will normally no longer have the statutory 14-day cancellation right.

But:

“I paid for it and the file doesn’t work”

or

“This isn’t the product that was described”

is different.

Your statutory rights relating to faulty or non-conforming digital content still apply.

Businesses cannot use contract terms to remove consumers’ statutory rights relating to faulty or misdescribed products.  

Your Personal-Use Licence

When you purchase My Eulogy File, you receive a non-exclusive, non-transferable personal-use licence to use the product for your own My Eulogy File.

You’re not purchasing the copyright or ownership of the workbook itself.

You are allowed to use it properly.

That includes the permissions below.

What You May Do

You may:

  • download your copy;
  • save it on your own devices;
  • print it for your own use;
  • make reasonable backup copies;
  • keep more than one copy for safekeeping;
  • annotate it;
  • use its prompts to create your own written answers;
  • use it over many years;
  • return to it and update your own File;
  • use the material you personally write in response to the workbook however you wish;
  • use your answers to write your own eulogy;
  • allow someone else to help you complete your File;
  • give your completed File to someone you trust for safekeeping;
  • allow the person or people dealing with your funeral or eulogy to access and use your copy after your death; and
  • allow an appropriate person to use your File to prepare, adapt, or deliver your eulogy in accordance with the instructions you have left.

You don’t need to buy another licence merely because the whole point of the product eventually requires another human being to read it.

Your Own Writing Belongs to You

This distinction matters.

We own the copyright in My Eulogy File and its original questions, prompts, guidance, structure, and other original material, subject to applicable law.

We don’t claim ownership of the stories, memories, answers, messages, eulogy, or other original material you create while using it.

Your life isn’t suddenly ours because one of our questions prompted you to write about it.

Your original writing remains yours, subject of course to any rights other people may have in material you include.

What You May Not Do

Your personal-use licence does not allow you to:

  • sell My Eulogy File;
  • resell your blank copy;
  • distribute blank copies to other people;
  • buy one copy for an entire family or friendship group;
  • upload the File to a website, shared drive, group, forum, or platform so other people can obtain copies;
  • email blank copies to other people for their own use;
  • distribute it to clients;
  • use one purchase for multiple workshop participants;
  • use it as course or training material for a group without permission;
  • reproduce substantial parts in another workbook, book, course, website, app, or product;
  • remove our branding and present the workbook as your own;
  • translate, adapt, or repackage it for commercial distribution without permission;
  • sell modified versions;
  • sublicense the workbook; or
  • systematically extract its content to create a competing resource or product.

In other words:

One purchase is for one person’s life.

Not one household.

Not one family.

Not one organisation.

One person.

Helping Someone Else Complete Their File

You may have somebody help you.

For example, you might ask a partner, family member, friend, carer, support worker, or other trusted person to help you:

  • read the questions;
  • type your answers;
  • write down what you dictate;
  • organise your File; or
  • use the workbook in a way that is more accessible to you.

That’s fine.

They don’t need their own licence merely to help you use your copy.

If they want to create their own My Eulogy File, however, they should purchase their own copy.

After Your Death

Your licence expressly permits the people responsible for dealing with your File, funeral, memorial, or eulogy to use your copy for that purpose after your death.

They may, where appropriate and consistent with the instructions you’ve left:

  • read your File;
  • make working copies where reasonably necessary;
  • extract relevant information;
  • use your answers;
  • use a eulogy you’ve written;
  • adapt a draft where you’ve permitted this; and
  • use the material to prepare or deliver your eulogy.

They may not use your copy as a blank template to create My Eulogy Files for themselves or other people.

We are not going to pursue your eulogy writer for copyright infringement because they printed the pages you specifically left for them.

That would rather defeat the object.

Professional, Group, and Organisational Use

The standard purchase is for personal use.

If you are a:

  • funeral professional;
  • celebrant;
  • counsellor or therapist;
  • death doula;
  • care organisation;
  • charity;
  • community organisation;
  • educator;
  • workshop facilitator;
  • employer;
  • professional adviser; or
  • anyone else wanting to use My Eulogy File with multiple people,

the standard personal licence does not give you permission to distribute copies to your clients, participants, members, or service users.

We may introduce professional, group, bulk, or organisational licensing later.

Accessibility and Alternative Formats

We want My Eulogy File to be usable by as many people as reasonably possible.

Accessibility is a work in progress.

If the standard supplied format creates an accessibility barrier for you, contact us at:

Tell us what format or adjustment would help.

You don’t need to provide medical evidence or explain a diagnosis.

Where reasonably possible, we will try to provide an alternative accessible format.

Providing an alternative format to you does not create an additional licence for distribution to other people.

Updates to My Eulogy File

My Eulogy File may develop over time.

We may correct mistakes, improve questions, change formatting, add material, remove material, or release substantially revised editions.

Buying one version does not automatically guarantee lifetime access to every future edition or new product unless we specifically say that it does.

We may choose to provide minor corrections or updated versions to existing purchasers.

We may also choose to sell a substantially new edition separately.

We’ll make clear what is included with your purchase.

This is not a subscription unless we expressly say otherwise.

Compatibility

Before purchasing, please check the product description for the format in which My Eulogy File is supplied.

You’ll need a device and appropriate software capable of opening that format if you intend to use it digitally.

We’ll aim to describe the supplied formats accurately.

If you need an accessible alternative format, please contact us as described above.

No Guaranteed Outcome

My Eulogy File is a writing and reflection resource.

We cannot guarantee that:

  • you’ll complete it;
  • you’ll enjoy every question;
  • you’ll remember everything accurately;
  • your family will agree with your version;
  • somebody will eventually use it;
  • your eventual eulogy will include everything you’ve requested;
  • the person dealing with your funeral will follow every instruction;
  • completing the File will make conversations about death easier; or
  • you will produce a finished eulogy.

People remain inconveniently independent.

The purpose of My Eulogy File is to give you a structured way to record your contribution.

What ultimately happens with that information may depend on circumstances outside our control.

My Eulogy File Is Not Professional Advice

My Eulogy File isn’t:

  • legal advice;
  • medical advice;
  • psychological advice or treatment;
  • counselling;
  • bereavement counselling;
  • financial advice;
  • funeral directing;
  • estate planning;
  • will writing; or
  • a substitute for appropriate professional services.

Some questions may lead you to think about matters where professional advice would be useful.

Please seek it where appropriate.

Responsibility for What You Write

You decide what goes into your personal File.

That includes decisions about:

  • accuracy;
  • privacy;
  • allegations about other people;
  • confidential information;
  • sensitive family information;
  • messages intended for particular people;
  • what should be shared after your death; and
  • what should remain private.

Our prompts don’t require you to disclose everything.

If something is highly sensitive, potentially defamatory, legally significant, or concerns another person’s private information, think carefully about whether and how you record or share it.

Where necessary, obtain appropriate professional advice.

Intellectual Property

Except for material created by you and any third-party material identified as such, My Eulogy File and its original contents are owned by Ceri Wood trading as Your Eulogy and protected by applicable intellectual property law.

Your purchase gives you the licence described in these Terms.

It does not transfer ownership of our intellectual property to you.

The personal-use permissions we’ve expressly granted are intended to be generous enough for the File to perform its purpose while preventing unauthorised redistribution and commercial copying.

AI Training, Scraping, and Automated Extraction

Purchasing My Eulogy File does not grant permission to use its content to train, fine-tune, develop, evaluate, or supply a generative AI or machine-learning system.

You must not systematically extract the workbook’s original content to:

  • build an AI training dataset;
  • create a competing AI eulogy product;
  • create a competing question or prompt database;
  • reproduce the workbook through automated means; or
  • commercially exploit its content through an AI system,

unless we have given prior written permission or applicable law expressly permits the activity in circumstances that cannot lawfully be restricted.

This doesn’t stop you from using ordinary tools to help you personally write, organise, edit, or access your own answers.

The concern is redistribution and exploitation of our workbook, not policing how you write your own eulogy.

Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Nothing in these Terms removes or restricts statutory consumer rights that cannot legally be excluded.

Subject to those rights, Your Eulogy isn’t responsible for consequences arising solely from:

  • personal decisions you make about what to write;
  • decisions made by other people after your death;
  • disagreements between family members;
  • somebody failing to find or use your File;
  • somebody choosing not to follow your non-binding personal wishes;
  • information you chose to disclose about another person; or
  • circumstances outside our reasonable control.

Consumer contract terms must be fair and cannot simply exclude statutory responsibility for faulty or misdescribed products.

If something has gone wrong with your purchase, please contact us.

  • what you would like us to do.

Please don’t send us your completed My Eulogy File as evidence.

We will deal with complaints reasonably and in accordance with applicable consumer law.

Changes to These Terms

We may update these Terms for future purchases if the product, business, technology, or applicable law changes.

The Terms applying to your purchase will generally be those presented to you when you made that purchase, subject to any mandatory legal requirements.

Updating the website later doesn’t allow us to retrospectively remove rights you already have.

Which Law Applies?

These Terms are governed by the laws of England and Wales, subject to mandatory consumer protections that may apply to you because of where you live.

If you’re a consumer elsewhere in the UK or another country, you may have mandatory rights under the laws applicable to you.

Nothing in these Terms is intended to remove rights that cannot legally be excluded.
